Terms of Service

1. Agreement to Terms

By accessing or using the DreamProp website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service.

These Terms constitute a legally binding agreement between you and DreamProp. The Service is operated from Ireland and these Terms are governed by Irish law.

2. Description of Service

DreamProp is a property discovery service that aggregates publicly available property listings from third-party European property websites. We provide:

  • A searchable database of European property listings
  • Customisable search filters to match your preferences
  • A weekly email digest of properties matching your criteria

DreamProp is an information aggregation service only. We are not an estate agent, property broker, or financial adviser. We do not sell, lease, or manage properties. All property transactions are conducted directly between you and the listing agent or seller via the original property website.

3. User Accounts

To use certain features of the Service, you must register for an account. When registering, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your password and account
  • Promptly update your information if it changes
  • Accept responsibility for all activity under your account

You must be at least 16 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free Access & Pricing

DreamProp is currently offered free of charge to early users. We reserve the right to introduce paid features or change our pricing model in the future. If we do so:

  • Existing free users will be given reasonable advance notice (at least 30 days) of any changes
  • You will not be charged without your explicit consent
  • You may cancel your account at any time if you do not wish to pay

Where payments are processed, they are handled securely by Stripe, Inc. in accordance with PCI DSS standards. By making a payment, you also agree to Stripe's terms of service.

5. Property Listings & Accuracy

Property listings displayed on DreamProp are sourced from third-party websites. While we make reasonable efforts to present accurate information:

  • We do not guarantee the accuracy, completeness, or availability of any listing
  • Prices, descriptions, images, and availability may change at any time on the source website
  • Listings may be delayed, outdated, or contain errors from the original source
  • We are not responsible for the content or practices of third-party property websites

You should always verify property details directly with the listing agent or seller before making any decisions or commitments.

6. Acceptable Use

When using the Service, you agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Scrape, crawl, or systematically extract data from the Service using automated means
  • Interfere with or disrupt the integrity or performance of the Service
  • Impersonate another person or entity
  • Use the Service to send spam, unsolicited messages, or malicious content
  • Reproduce, redistribute, or commercially exploit the Service or its content without our written permission

7. Intellectual Property

The DreamProp name, logo, website design, and original content are owned by DreamProp and protected by copyright and intellectual property laws.

Property listing data (descriptions, images, prices) remains the intellectual property of the respective property websites and their users. We display this data under fair use principles for the purpose of providing an aggregation and discovery service.

8. Email Communications

By creating an account and setting up a property filter, you consent to receiving your weekly property digest email. You can stop these emails at any time by:

  • Deactivating your filter from the dashboard
  • Deleting your account
  • Contacting us at info@dreamprop.eu

We may also send essential service communications (e.g. password resets, security alerts, important changes to the Service). These are transactional in nature and cannot be opted out of while you maintain an account.

9. Limitation of Liability

To the fullest extent permitted by Irish and EU law:

  • The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
  • We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
  • DreamProp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
  • Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
  • We are not liable for any loss arising from decisions made based on property information displayed on the Service.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Irish law.

10. Indemnification

You agree to indemnify and hold harmless DreamProp from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

11. Account Termination

You may delete your account at any time from your profile settings. Upon deletion:

  • Your personal data will be erased in accordance with our Privacy Policy
  • Your search preferences and email history will be permanently deleted
  • Any active paid subscription will be cancelled

We reserve the right to suspend or terminate your account if you breach these Terms, with or without prior notice depending on the severity of the breach.

12. Third-Party Links

The Service contains links to third-party property websites. These links are provided for your convenience only. We have no control over and accept no responsibility for the content, privacy policies, or practices of any third-party websites. Your use of third-party websites is at your own risk.

13. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via email or a prominent notice on the website at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.

If you are a consumer in the European Union, you also have the right to submit a complaint through the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
